GENERAL TERMS OF BUSINESS

It is specified above that these general terms of business exclusively govern the sales by FIREPLACE INSERT GLASS of products available on the web page www.fireplace-insert-glass.co.uk.

ARTICLE 1 - PRICE

1.1 - The prices of our products are indicated in Euros with all taxes included but exclusive of processing and delivery costs.

1.2 - All orders are payable in Euros, irrespective of their origin.

1.3 - FIREPLACE INSERT GLASS reserves the right to change its prices at any time but the products will be invoiced on the basis of the prices applicable at the time in which your order is validated.

1.4 - Title retention clause: the products remain the property of FIREPLACE INSERT GLASS until payment has been made in full to FIREPLACE INSERT GLASS.

ARTICLE 3 - VALIDATION

When you confirm your order, you agree to accept it and all of these General Terms fully and without reserves. Any data recorded by FIREPLACE INSERT GLASS constitute proof of all the transactions carried out by FIREPLACE INSERT GLASS and its customers.
FIREPLACE INSERT GLASS may not be held responsible for any consequences arising as a result of an error in the information provided by the customer, especially concerning their address details or the sizes of the ordered product.


ARTICLE 4 - AVAILABILITY

Our product offers and prices are valid for the time that they are visible on the site, subject to availability. In the event that a product is unavailable after you have placed your order, we will notify you by e-mail as soon as possible. You may then request that your order be cancelled by e-mail.


ARTICLE 5 - DELIVERY AND PRODUCT CONFORMITY

5.1 General terms
The products purchased at www.fireplace-insert-glass.co.uk are delivered to mainland France, including Corsica, overseas departments and territories, except for products (glass) which have specific features, and various European countries (countries proposed in the order process). The products are delivered to the delivery address that you indicate during the order process or to a Pick-up point in the event that the transport operator is unable to deliver to your home. The fact that the package is directly delivered to the pick-up point does not give the purchaser the right to cancel the sale, refuse the goods or claim any damages.
FIREPLACE INSERT GLASS undertakes to make every effort to ensure that the order is delivered at the earliest possible time following receipt of payment and the purchase order. The delivery periods indicated on our site are for information purposes only and any delays do not entitle the purchaser to cancel the sale, refuse the goods or claim any damages.

5.2 - Delivery problems
Products sold by FIREPLACE INSERT GLASS  are transported in all cases at the risk of the customer, who is responsible for making any claim according to the provisions of this article. It is essential that you check that the delivered goods are up to standard and fit for purpose when the delivery is made and before signing the purchase order. You must also indicate any delivery problems (fault, damaged product, etc.) on the delivery slip in your own handwritten reservations accompanied by your signature. You must also confirm any reservations to the transport operator not later than two working days following receipt of the item(s) and send a copy of this letter to FIREPLACE INSERT GLASS. If the products need to be returned to us, this must be done not later than two working days following delivery. Any claim made outside of this period may not be accepted. The customer must notify FIREPLACE INSERT GLASS in advance by e-mail, to the address info@capska.fr, of the reason for the return and request a return number which must be displayed on the package so that it may be identified. The address to which the package must be returned will then be indicated. Returned products will only be accepted in their original packaging.
In some cases (damaged products during delivery), an identical product will be sent out again.

5.3 - Size-related problems of glass and tolerance thresholds
The glass is cut according to the sizes that you indicate when placing your order (the sizes indicated on the purchase order that you receive by e-mail prevail in the event of a dispute). However, a difference in the sizes cut of 1mm between the sizes indicated by you and those actually cut is acceptable (as the cutting tool does not provide accuracy to the nearest mm), it is therefore essential that you check that you have allowed for 5mm between your glass and its frame.
If you notice that you have made an error in your measurements when you receive the glass (incorrect measurement of the necessary glass, too big or too small), no exchanges or refunds will be made on the grounds that it is not possible to re-cut a piece of glass over a few centimetres or re-use the glass for other purposes.

5.4 - Express delivery
For urgent needs (payment by bank card recommended), we have set up an optional "Express 48-hour Delivery" service for €15.
If you order before 12.30pm during the week (from Monday to Friday), your order is prepared and sent on the same day and delivered within 48 hours.
If you choose this option when placing an order on Saturday or Sunday, your order is prepared and sent on Monday and will be delivered on Wednesday.
If you order after 12.30pm but you do, in fact, select this "Express 48-hour Delivery" service, your order is prepared and sent the following day and delivered within 48 hours.

In the event of problems in the express delivery (except for delays linked to the weather or a problem locating your address), a claim may be made by e-mail to info@capska.fr.


ARTICLE 6 - PAYMENT

You may pay for your orders either by check or bank card.

By check:
By bank card issued by a bank incorporated in mainland France.
The check is cashed upon receipt thereof. The check, accompanied by the purchase order, will be sent to the address:

Only Mastercard and Visa bank cards are accepted.
The user of these cards undertakes and guarantees FIREPLACE INSERT GLASS that he/she has all the authorisations required to use these cards.
They particularly promise that they are the owners and entitled to use them.

The charges of purchases made by bank card will be collected by FIREPLACE INSERT GLASS within 3 working days following the order, irrespective of the availability of the ordered item(s).

FIREPLACE INSERT GLASSreserves the right to suspend any order and delivery if officially certified bodies refuse to authorise the payment by bank card or in the event of non-payment.

FIREPLACE INSERT GLASSalso reserves the right to refuse to make a delivery or honour an order made by a customer who has not paid for a previous order either in full or in part or for which a payment dispute has been initiated.


ARTICLE 7: SECURITY

Our site is covered by a security system: we have adopted the SSL encryption process.
Under no circumstances are your bank details known to FIREPLACE INSERT GLASS : our banking partnership (BNP PARIBAS) is the only authorised party to process them.


ARTICLE 8 - RIGHT OF WITHDRAWAL

By virtue of Article L121-20 of the Consumer Code, customers have seven clear days as of the delivery of their order to return products to FIREPLACE INSERT GLASS, for an exchange or refund, incurring no penalties except for return costs. The products must be in perfect condition in their original packaging. Customers must previously inform FIREPLACE INSERT GLASS by e-mail, to the address info@capska.fr, of the reason for the return and request a return number which must be displayed on the package so that it may be identified. The address to which the package must be returned will then be indicated. However, by virtue of Article L121-20-2 of the Consumer Code, the right of withdrawal may not be exercised when goods made according to the specifications of the consumer are supplied. This lack of the right of withdrawal especially applies to glass fireplace inserts cut according to the sizes specified by the customer.


ARTICLE 9 - REFUND

Product refunds in the scenarios mentioned in Articles 5 and 8 will be made as soon as possible and not later than 30 days following the date on which the right has been exercised.
The refund will take the form of a bank check addressed to the customer who placed the order and to the invoicing address.

ARTICLE 10 - RESPONSIBILITY

FIREPLACE INSERT GLASS may not be held responsible for the failure to comply with the concluded agreement in the event that the stock is broken or the product is unavailable or in a case of force majeure, disturbance or total or partial industrial action, especially concerning the postal services and methods of transport and/or communication, flooding, fire and other major risks. FIREPLACE INSERT GLASS will incur no liability for any indirect damage on account of these documents, operating loss, loss of profit, loss of opportunity, damages or fees which could occur on account of purchasing the products.

ARTICLE 11 - APPLICABLE LAW - LAWSUITS

This agreement is subject to French law. The language of this agreement is French.


ARTICLE 12 - PERSONAL DATA

FIREPLACE INSERT GLASS undertakes not to disclose to third parties the information that you provide. This is confidential. It will only be used by internal services to process your order.
In accordance with the French Data Protection Act of 6 January 1978, you have a right of access, rectification and opposition to your own personal data.
